Page 2 <br /> 2. The applicant shall apply for and receive all other required local, state and federal permits <br /> before extraction commences and proof shall be on file with both the Dane County <br /> Planning and Development Department and the Town of Mazomanie. <br /> 3. There shall be no use of any Town of Mazomanie roads by any hauler either for <br /> approaching or leaving the subject site, except to deliver material as a final destination to <br /> a site in the Town of Mazomanie or by permission of the Mazomanie Town Board. <br /> 4. Operator will create an 10 foot landscaped earthen berm around the opened area of the pit <br /> and along STH 78 the berm will have a row of deciduous trees of appropriate type, <br /> spacing and height as determined by the Planning and Development Department for the <br /> purpose of mitigating the noise and for visual and safety concerns of the neighbors. The <br /> berm shall be seeded and maintained in a sightly condition and mowed periodically to <br /> prevent weed infestation. <br /> 5. The operator shall develop and operate the site according to the proposed operations, <br /> erosion control and reclamation plan dated March 01, 2001. The reclamation is subject to <br /> change in order to meet requirements of NR135. <br /> 6. The failed berm on the Southern boundary of the CUP area and the neighbor's property <br /> (parcel #0806-104-8000-1) shall be replaced in accordance with previous reclamation <br /> plans and shall meet the reasonable satisfaction of the Mazomanie Town Board. This <br /> berm shall be repaired before any mineral extraction activities commence on subject <br /> property. <br /> 7. Operations shall cease no later than fifteen (15) years from the date of CUP approval <br /> unless review shows that an extension is warranted. <br /> 8. The total disturbed area of the site shall not exceed twenty (20) acres at one time, <br /> excluding berms. <br /> 9. Reclamation shall meet requirements as defined in NR135. The property shall be <br /> reclaimed to farming and agricultural uses. The operator agrees to stockpile the topsoil <br /> separately from the overburden and to replace the overburden and topsoil in the proper <br /> sequence. Final reclamation of the site shall be completed within twelve (12) months of <br /> the expiration of the CUP. <br /> 10. To ensure compliance with the reclamation plan, the operator shall post and maintain a <br /> bond or irrevocable letter of credit in favor of Dane County in the amount of $30,000 <br /> ($1,500 per acre of disturbed area up to a maximum of 20 acres) until reclamation is <br /> satisfactorily completed. <br /> Once Chapter 74 (NR135) is passed, it will likely include a similar requirement for <br /> reclamation bonding. If possible under State requirements, this County bonding <br /> requirement shall count toward whatever bonding is required by the State. The intent here <br /> is to avoid double counting any reclamation bonding. <br /> 11. The first 150' of the driveway accessing the subject site shall be paved. The operator shall <br /> maintain the driveway in a dust free manner in accordance with local, state, and federal <br /> regulations, and shall clean any dust or mud tracked onto public roads. <br />
