Page 4 <br /> 24. All private wells within a three-tenths (.3) mile radius from the subject property in the <br /> path of the groundwater flow shall be tested at the applicant's expense before any soil <br /> disturbance takes place. Independent qualified examiners will perform such testing and <br /> the examiners shall maintain a permanent record. The Mazomanie Town Board shall <br /> designate the independent qualified examiner(s). Each well shall be tested, at Yahara <br /> Materials expense every three years thereafter to monitor any changes in water quality. <br /> In the event that two or more wells show evidence of contamination or substantially <br /> reduced water supply, as a result of the mineral extraction operation, as verified by a <br /> certified hydrologist, the Dane County Zoning Division will be notified and an inspection <br /> conducted. <br /> 25. The mineral extraction site shall be designed so that trucks will maintain a forward <br /> direction while entering, loading and leaving whenever possible. <br /> 26. Placement and use of asphalt plants and concrete plans are specifically forbidden for the <br /> entire subject property for the entire duration of the CUP. <br /> 27. Trucks shall not use engine brakes (jake brakes) in the vicinity of the mineral extraction <br /> site. <br /> 28. Dane County and the Town of Mazomanie shall be listed as additional named insureds on <br /> the operator's liability insurance policy, which shall be for a minimum of $1,000,000 <br /> combined single limit coverage per occurrence. The operator shall furnish a copy of a <br /> Certificate of Insurance as evidence of coverage before operations may commence. The <br /> liability insurance policy shall remain in effect until two (2) years after reclamation is <br /> complete. Copies of appropriate insurance policies shall be filed with the Town of <br /> Mazomanie. <br /> 29. The zoning administrator or designee may enter the premises of the operation to inspect <br /> those premises with reasonable advance notice to ascertain compliance with these <br /> conditions or to investigate an alleged violation. Anyone inspecting the property will be <br /> escorted by Yahara Materials and will comply with all safety regulations. <br /> 30. If any portion of these conditions is held invalid the remainder of these conditions and <br /> provisions shall not be affected thereby. <br /> THE ZONING AND NATURAL RESOURCES COMMITTEE AFTER PUBLIC HEARING <br /> AND IN THEIR CONSIDERATION OF THE CONDITIONAL USE PERMIT MADE THE <br /> FOLLOWING FINDING OF FACT: <br /> 1 . That the establishment, maintenance and operation of the <br /> proposed conditional use will not be detrimental to or endanger <br /> the public health, safety, morals, comfort or general welfare. <br /> 2 . That the uses, values and enjoyment of other property in the <br /> neighborhood for purposes already permitted will not be <br /> substantially impaired or diminished by the establishment, <br /> maintenance and operation of the proposed conditional use. <br /> 3. That the establishment of the proposed conditional use will not <br /> impede the normal and orderly development and improvement of <br /> the surrounding property for uses permitted in the district. <br />
