specifically ingress and egress to Parcel A f r o m Viaduct Road. 0 0 1 0 q 1 <br /> 3. The owners of Parcel A shall have sole responsibility for the construction, <br /> maintenance,repairs and snow removal of said Easement; except the owners of <br /> Parcel C shall reimburse the owners of Parcel A 50% of all costs for construction, <br /> maintenance and repair required for the immediate access of the Easement to <br /> Viaduct Road. The immediate access shall include culverts, curbs, and driveway <br /> costs associated with the easterly 66 feet of the northerly 66 foot easement <br /> identified on CSM#10284. <br /> 4. The owners of Parcel B shall have no right to use said Easement described in <br /> paragraph 1 above. Parcel B's access is limited to the easement identified in Parcel <br /> C,a 66 foot wide private access easement which provides ingress and egress to <br /> Parcel B from C.T.H. `DM'. The owners of Parcel B shall be responsible for all <br /> costs of the maintenance,construction, repair and snow removal of that easement. <br /> However,if the owners of Parcel B formally vacates the use of the easement from <br /> C.T.H. `DM'by a recorded document, they may commence use of the easement for <br /> ingress and egress described in Paragraph 1 above. At that point, the owners of <br /> Parcel B shall reimburse the owners of Parcel A 50%of any costs thereinafter <br /> incurred for the construction,maintenance,repair and snow removal of said <br /> easement. The owners of Parcel B shall also reimburse the owners of Parcel A 33% <br /> of all costs thereafter incurred for construction, maintenance and repair for the <br /> immediate access of the easement to Viaduct Road identified in Paragraph 3 above. <br /> At said time the owners of Parcel C shall reimburse the owners of Parcel A 33% <br /> instead of 50%of the cost identified in paragraph 3 above. <br /> 5. The grant and other provisions of this Easement shall constitute a covenant running <br /> with the Iand for the benefit of or enforceable against Tallard,Tallard's heirs, <br /> successors and assigns. <br /> /-d: S- off ( .
