Main Street <br /> Dane, WI 53529 Records&Support <br /> (608)266-4251,Rm. 116 <br /> RE: Zoning Petition #10832 Zoning <br /> (608)266-4266,Rm. 116 <br /> Dear Ms. Volkman, <br /> At the May 26th Zoning and Land Regulation Committee meeting, Petition#10832 for Richard Eberle was <br /> postponed to allow the applicant time to address concerns made by County Staff. See attached staff <br /> report. County Staff requested that the petition be deny for the following reasons: <br /> 1. The proposed residential lot conflicted with the Open space/Environmental Corridor policies found in <br /> the Town of Dane Comprehensive Plan. <br /> 2. The existing building contained within the boundaries of the proposed lot is designed for commercial <br /> use and would be in violation of the uses found in the Rural Homes Zoning District. <br /> 3. The existing farm residence appears to be in violation of the Document of Understanding towards an <br /> inactive Farm Plan. <br /> Since that time, Mr. Eberle has revised his proposal in order to address the concerns. He has <br /> reconfigured the residential lot to allow for a 2.7-acre parcel showing a building envelope <br /> contained around the accessory building. This newly configured lot would be assigned the zoning <br /> district classification of RH-1. He has also requested that the remaining 75 acres.of A-1 Exclusive <br /> Agriculture lands be rezoned to RH-4 to account for the existing residential house in an ag <br /> preservation area. <br /> County Staff finds the proposed changes reasonably acceptable to address the outstanding <br /> concerns on the property. The reconfigured lot moves the building envelope outside the wetland <br /> area and addresses the existing accessory building concerns. Rezoning of the remaining lands <br /> addresses the inactive farm plan. <br /> This information is being sent to you so that the Town of Dane can formally act on the proposed <br /> changes to see if it will be acceptable to the Town. Please have this information placed on the <br /> next Town Board agenda for review. <br /> If found acceptable, County Staff suggests the following conditions are placed on the Petition <br /> #10832: <br /> 1. The petition is amended to create a 2.7-acre residential lot as noted on the attached CSM. <br /> The lot shall be assigned the zoning district classification of RH-1. <br /> 2. A deed restriction shall be recorded on the 2.7-acre lot to prohibit any commercial activity on <br /> the property. <br /> 3. The petition is amended to assign the zoning district classification of RH-4 to the remaining 75 <br /> of A-1 Exclusive Agriculture property. <br />
