Jefferson Street <br /> Verona, Wisconsin 53593 <br /> Dear Mr. Johnson : <br /> It is my understanding you are attempting to rezone a parcel of <br /> land presently owned by Dale N. Chestnut and Debra J. <br /> Chestnut. This parcel of land is located in the NE-1/4 of the <br /> NW-1/4 of Section 25 , T6N, R7E, Town of Springdale, Dane <br /> County, Wisconsin . <br /> The parcel originally was purchased by Donald and Vera <br /> Chestnut, husband and wife as joint tenants, from Clinton P. <br /> Dahlk and Sharon Sue Dahlk, on May 18 , 1972 . <br /> The deed contained a provision which provided that the "said <br /> premises shall not be sub-divided into parcels of less than <br /> three acres for a period of 10 years. Any residence construc- <br /> ted on any parcel shall have not less than 1400 square feet of <br /> living area and a 2 car garage attached or non-attached <br /> garage . " <br /> Donald and Vera Chestnut, having sold off certain parcels , <br /> continued to own the premises until Donald' s death in 1985. <br /> The joint tenancy was terminated and the property remaining <br /> from the original parcel was owned by Vera C. Chestnut. She <br /> sold the premises in question to her son and daughter-in-law , <br /> Dale and Debra Chestnut on February 25 , 1987 . The Warranty <br /> Deed did not contain the 10 year restriction referred to <br /> above . It is therefore my opinion the premises purchased by <br /> Dale and Debra Chestnut is not subject to the deed restrictions <br /> provided in the original deed of May 18 , 1972 . It expired in <br /> 1982 . <br /> Donald and Vera Chestnut did sell off certain parcels of land <br /> that contained the same restrictions as in their original <br />
