The 75 ft. setback is a <br /> county zoning requirement and there is a variance process for that, so you should talk to zoning staff to see what the odds <br /> are of getting a variance to the setback. <br /> As for the wetland boundary, an accurate line is important since it dictates where the setback is and dictates where you <br /> can and cannot do work. Jeff Kraemer is a good wetland delineator and you will get a good product from him. <br /> I don't know if this is a new subdivision or not, but I can tell you that it is very common for developers to plat subdivisions <br /> adjacent to wetlands and include part or all of the 75 foot setback in the lot's"backyard"and very often portions of the <br /> wetland as"backyard"too. What this means is there is then only buildable space for the house and attached garage at <br /> the front of the lot. This sounds similar to your situation. Unfortunately, I get lots of calls/emails from frustrated <br /> landowners that can't add on or build accessory structures because of this. <br /> I hope I answered your questions for me. As a fellow civil servant I have an appreciation for these types of contacts. <br /> I understand why people get frustrated and consider permitting processes daunting. <br /> I assume by definition that the intermittent stream is navigable and therefore triggers the need for the permit. I <br /> don't always understand the navigable definition but can agree with it. <br /> I have no problem completing whatever permits are needed. I do take issue with the extent of the wetland area. <br /> I would attach a photo but it may be too large for email. We would like to improve the habitat of the back <br /> corner of our lot(no mow w/native plants or wildflowers). If the previous owner removed the wetland <br /> vegetation,we would like to restore it. I believe the mapped area is a wetland because of the soil type since <br /> there is typically no standing water. <br /> 1 <br />
