Lane Ill <br /> Dane County Zoning Administrator <br /> To: Zoning Division Staff <br /> RE: Projects on lots within the Shoreland District <br /> On January 19, 2007, the Board of Adjustment made a ruling in regard to an appeal of the <br /> previous Zoning Administrator's interpretation of substandard lots in the Shoreland District. <br /> Before the ruling, all legal lots of record were considered "buildable". The Board of Adjustment <br /> found that the general provisions of Chapter 10 Zoning Ordinance with regard to existing platted <br /> lots could not be used to determine a shoreland lot status because the criteria did not address <br /> the scope of Shoreland regulations. Lots within the Shoreland District would need to meet the <br /> dimensional standards found within Chapter 11 Shoreland Ordinance to be a "buildable" lot. <br /> After this decision, the Zoning Division was very prudent in enforcing this ruling by the Board of <br /> Adjustment. To avoid any additional controversy, Staff determined that all projects requiring a <br /> zoning permit within the Shoreland District would need to meet minimum lot standards found in <br /> the Shoreland Ordinance, or a variance for these dimensional standards would need to be <br /> obtained for the existing lot of record. The outcome of this action spurred a tremendous <br /> workload in processing projects in the Shoreland District, created a high resistance by the public <br /> to obtain zoning permits for projects, and produced a skewed role for the Board of Adjustment. <br /> To honor the ruling of the Board of Adjustment with regard to existing lots within the Shoreland <br /> District while balancing environmental protection with respect for property rights of the public, <br /> the following policy will be in effect as of the date of this interpretation: <br /> ❑ The Zoning Division will begin issuing zoning permits for additions and structural <br /> alterations on properties within the Shoreland District that have existing buildings. All <br /> additions or alterations will need to meet all the provisions and dimension standards of <br /> the applicable zoning district, including setback provisions of the Shoreland District. <br /> (Note:This does not apply to vacant lots.) <br /> ❑ Additions or alterations to the existing structures, which exceed 50% of the pre-existing <br /> structure will be deemed new structure and will be subject to the minimum lot <br /> dimensions found in Chapter 11 Shoreland District Ordinance. <br /> ❑ Any new or replacement principal structures on legal lots within the Shoreland area will <br /> need to meet the dimensional standards within the Shoreland Ordinance or obtain a <br /> variance for relief from the minimum dimensional standards. <br /> Page 1 of 1 <br /> 210 Martin Luther King Jr.Blvd.+Room 116,City-County Bldg.❖Madison,WI 53703-3342+Phone:608.266.4266❖Fax:608.267.1540 <br />
