The owner later obtained a erosion control and <br /> stormwater management permit(ES2009-0167) through our office. The plan shows filling to the property line for <br /> the construction of a 35'x 72' building. If the fill has been placed outside the approved limits shown on the plan I <br /> can force them to remove it. The owner hired an engineer and the lot was surveyed and staked so I'm surprised to <br /> hear that they filled beyond their lot lines. Your pictures sure do look like it's close. <br /> The drainage ditch serves the regional stormwater basin and is part of the overall stormwater management plan <br /> for Larue Fields. I made the property owner aware of that fact when I met with him on site. One of my initial <br /> discussions with the owner was that the drainage ditch could not be touched. <br /> I'll take a look at the site early next week. If they are in non-compliance with their plan or the fill is obstructing the <br /> ditch I can force them to remove it. Otherwise, this would likely fall under a trespass or civil issue.
