DANE COUNTY ORDINANCE AMENDMENT NO. 7281 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Medina. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Medina be amended to include in the RH-1 and RH-2 Rural Homes <br /> District's the following described land: <br /> PETITION NUMBER: 7281 <br /> , TO R11-2: Part of the SW 1/4 of the NW 1/4 of Section 12, Town of Medina <br /> described as follows: Commencing at the West quarter corner of Section 12; thence <br /> N00°45'East along the West line of the SW 1/4 NW 1/4, 540 feet to the point of <br /> beginning; thence continue N00°45' East along said West line, 691 feet to the South line <br /> of the CM ST P & P Railroad; thence N79°47' East along said South line, 386 feet; <br /> thence S03° 39' West, 430 feet; thence S43°31' West, 201 feet; thence S48°36' West, <br /> 267 feet; thence N89°15' West, 33 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERT'IF'IED SURVEY REQUIRED <br /> The above listed description's is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> TO R11-1: Part of the NW 1/4 of the NW 1/4 of Section 12, Town of Medina, <br /> described as follows: Commencing at the Northwest corner of said Section 12; thence <br /> N90° East, along the North line of said NW 1/4, 850 feet; thence S00° West, 125 feet to <br /> the point of beginning;thence N90°East, 110 feet; thence S00° West, 75 feet, thence S65° <br /> East, 60 feet; thence N90° East, 155 feet; thence S00° West, 267 feet; thence S90°West, <br /> 217 feet; thence N29°18'38" West, 209.13 feet; thence N00°East, 185 feet to the point of <br /> beginning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.That no further residential development will be allowed on the W1/2,NW 1/4,section 12,after Petition 7281, <br /> which shall include parcels 0812-122-8500-1 and 0812-122-9000-4. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their finding to be ( <br /> consistent with the provisions of Wisconsin State Statute 91.77 (1)(a),(b),(c). %), <br /> CiA <br />
