DANE COUNTY ORDINANCE AMENDMENT NO. 9190 <br /> -lending Section 10.03 relating to Zoning Districts in the Town of Burke. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of <br /> Burke be amended to include in the C-2 Commercial District/s the following described land: <br /> PETITION NUMBER: 9190 <br /> A part of Lot#1 Certified Survey Map#5458 located in the SE 1/4 SW 1/4 of Section 35, Town of Burke described <br /> as follows: Commencing at the South quarter corner of said Section 35; thence NO2°26'04" East, 69.30 feet to the <br /> North right-of-way line of County Highway T; thence along said North right-of-way line S88°51'00"West, 337.15 <br /> feet; thence continuing along said North right-of-way line S89°22'00"West, 610.44 feet to the Southwest corner of <br /> Lot#2 Certified Survey Map#5458; thence along the West line of said Lot#2 NO3°47'58"West, 294.05 feet to the <br /> Northwest corner thereof; thence along the North line of said Lot#1 N89°23'00" East, 170.00 feet to the Northeast <br /> corner thereof and the East line of said Lot#1; thence along said East line N00°26'04" East, 70.01 feet to the point <br /> of beginning; thence continuing along said East line N00°26'04" East, 354.21 feet to the Northeast corner of said <br /> Lot #1; thence along the North line of said Lot #1 S89°42'36" West, 511.14 feet to the Northwest corner of said <br /> Lot#1; thence along the West line of said Lot #1 S00°23'00" West, 345.67 feet; thence S88°41'32" East, 340.75 <br /> feet; thence N89°23'00"East, 170.11 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following condition(s). <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if within 90 days of its adoption by Dane County the owner or owners of the <br /> land record the following restriction(s) on said land: <br /> 1) Deed restrict the C-2 area described above to limit the use of the property exclusively to: 1)parking or <br /> storing of motor vehicles; 2)mini-warehouses, and; 3) warehouses. <br /> Said restriction(s) shall run in favor of Dane County and the pertinent Town Board(s) as well as the owners of <br /> land within 300 feet of the site. Failure to record the restriction(s) will cause the rezone to be null and <br /> void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> ffective.
