DANE COUNTY ORDINANCE AMENDMENT NO. 9190 -lending Section 10.03 relating to Zoning Districts in the Town of Burke. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Burke be amended to include in the C-2 Commercial District/s the following described land: PETITION NUMBER: 9190 A part of Lot#1 Certified Survey Map#5458 located in the SE 1/4 SW 1/4 of Section 35, Town of Burke described as follows: Commencing at the South quarter corner of said Section 35; thence NO2°26'04" East, 69.30 feet to the North right-of-way line of County Highway T; thence along said North right-of-way line S88°51'00"West, 337.15 feet; thence continuing along said North right-of-way line S89°22'00"West, 610.44 feet to the Southwest corner of Lot#2 Certified Survey Map#5458; thence along the West line of said Lot#2 NO3°47'58"West, 294.05 feet to the Northwest corner thereof; thence along the North line of said Lot#1 N89°23'00" East, 170.00 feet to the Northeast corner thereof and the East line of said Lot#1; thence along said East line N00°26'04" East, 70.01 feet to the point of beginning; thence continuing along said East line N00°26'04" East, 354.21 feet to the Northeast corner of said Lot #1; thence along the North line of said Lot #1 S89°42'36" West, 511.14 feet to the Northwest corner of said Lot#1; thence along the West line of said Lot #1 S00°23'00" West, 345.67 feet; thence S88°41'32" East, 340.75 feet; thence N89°23'00"East, 170.11 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following condition(s). DEED RESTRICTION REQUIRED This amendment will be effective if within 90 days of its adoption by Dane County the owner or owners of the land record the following restriction(s) on said land: 1) Deed restrict the C-2 area described above to limit the use of the property exclusively to: 1)parking or storing of motor vehicles; 2)mini-warehouses, and; 3) warehouses. Said restriction(s) shall run in favor of Dane County and the pertinent Town Board(s) as well as the owners of land within 300 feet of the site. Failure to record the restriction(s) will cause the rezone to be null and void. A copy of the recorded document shall be submitted to Dane County Zoning. ffective.
