Six Standards of a Conditional Use Permit <br /> Provide an explanation on how the proposed land use will meet all six standards. <br /> 1. The establishment, maintenance or operation of the conditional use will not be detrimental to or endanger the <br /> public health, safety, comfort or general welfare. <br /> The proposed conditional use of a non-metallic quarry operation has existed on the parcel for nearly two (2) <br /> decades and there have been few(if any) complaints from surrounding property owners. The subject parcels <br /> 3 are rural in nature with adequate access to county and state highways. The applicant does not foresee that the <br /> activities proposed herein will be detrimental to or endanger the public health, safety, comfort or general welfare. <br /> 2. The uses, values and enjoyment of other property in the neighborhood for purposes already permitted shall be in <br /> no foreseeable manner substantially impaired or diminished by establishment, maintenance or operation of the <br /> 3 conditional use. <br /> 3 There is only one (1) residential property that is adjacent to the subject parcel and, since the non-metallic quarry <br /> operations commenced nearly two(2) decades ago, the applicant is not aware of any complaints from said <br /> neighbor or any other neighboring property owner. Furthermore, the applicant and/or operator will not be <br /> traveling on neighboring town roads, but will merely access county and state highways by using a private"haul <br /> 3 road"that runs over and across the property immediately to the south. <br /> 3. That the establishment of the conditional use will not impede the normal and orderly development and <br /> improvement of the surrounding property for uses permitted in the district. <br /> The applicant does not envision and cannot foresee that the conditional use applied for herein will impede <br /> the normal and orderly development and improvement of the surrounding property. This property has <br /> been used as a non-metallic quarry operation for nearly two (2) decades and the applicant is not aware of any <br /> interference with development or improvement to date. <br /> 3 4. That adequate utilities, access roads, drainage and other necessary site improvements have been or are being <br /> made. <br /> 3 All quarry entrance and "haul roads" have been properly paved and have been improved as recently as April 26, <br /> 2016. Otherwise, all utilities serving the subject property are in good working order to the extent <br /> required by the applicant and/or operator. <br /> 3 <br /> 5. Adequate measures have been or will be taken to provide ingress and egress so designed as to minimize traffic <br /> 3 congestion in the public streets. <br /> The applicant and operator will not use any local town roads to haul aggregate, but instead will use a <br /> private"haul road"to connect the quarry site directly to County Hwy B. <br /> 6. That the conditional use shall conform to all applicable regulations of the district in which it is located. <br /> The owner and operator fully intend to strictly conform and comply with all applicable regulations of the <br /> underlying zoning district as well as any terms and conditions imposed by virtue of a conditional use permit <br /> in the event that the same is approved. <br /> J <br />
