Proposed Conditional Use Permit #2346 <br /> In order for an applicant to obtain a Conditional Use Permit, the Zoning and Land Regulation <br /> Committee must find that all of the following standards are met for the proposed land use: <br /> 1. The establishment, maintenance, or operation of the conditional use will not be detrimental to or endanger the public <br /> health, safety, comfort or welfare. <br /> 2. The uses, values and enjoyment of other property in the neighborhood for purposes already permitted shall be in no <br /> foreseeable manner substantially impaired or diminished by establishment, maintenance or operation of the <br /> conditional use. <br /> 3. The establishment of the conditional use will not impede the normal and orderly development and improvement of the <br /> surrounding property for uses permitted in the district. <br /> 4. Adequate utilities, access roads, drainage and other necessary site improvements have been or are being made; and <br /> 5. That adequate measures have been or will be being taken to provide ingress and egress so designed as to minimize <br /> traffic congestion in the public streets; and <br /> 6. That the conditional use shall conform to all applicable regulations of the district in which it is located. <br /> Staff has prepared a list of conditions that may be used in order to meet the six standards as listed <br /> above to allow the conditional use on the property. Please note that the conditions may need to be <br /> changed or additional conditions added to address potential nuisances that may come to light during <br /> the public hearing. <br /> 1. The applicant shall submit an erosion control plan covering the entire CUP area for the <br /> duration of operations, and receive approval of an erosion control permit prior to <br /> commencing extraction operations. <br /> 2. The applicant shall apply for and receive all other required local, state, and federal <br /> permits. <br /> 3. The operator shall develop and operate the site according to the submitted site and <br /> operations plan. <br /> 4. Operations shall cease no later than ten (10) years from the date of issuance of the <br /> conditional use permit. <br /> 5. Reclamation shall be completed within one year after operations have ceased, and shall <br /> be phased according to the revised operations and reclamation plan. <br /> 6. Reclamation shall meet requirements of Chapter 74 of the Dane County Code of <br /> Ordinances. <br /> 7. All drive aisles shall be either graveled or paved according to operations plans, and shall <br /> be maintained in a dust free manner in accordance with local, state, and federal <br /> regulations. <br /> 8. Open excavation area shall not exceed twenty (20) acres. <br /> 9. Hours of operation shall be as follows: <br /> a. Operations shall be limited to 6:00 a.m. to 9:00 p.m. Monday through Friday and <br /> 7:00 a.m. to 12:00 p.m. on Saturday. There shall be no Sunday operations. <br /> b. Blasting shall be limited to 9:00 am to 4:30 pm Monday through Friday. <br /> c. Crushing of stone shall be limited to 6:00 a.m. to 9:00 p.m., Monday through <br /> Friday. Crushing shall not be permitted on Saturday, Sunday or legal holidays. <br /> d. For Wisconsin Department of Transportation (WisDOT) projects, <br /> hauling/transport of material will occur 24 hours per day/7 days per week, with <br /> the exception of Sunday evenings. Hauling for local municipal and/or commercial <br /> projects will be limited to 6:00 a.m. to 9:00 pm Monday through Friday, and 7:00 <br /> a.m. to 12:00 pm on Saturday. <br />
