Bjoin Limestone was <br /> not the operator at the time of the issuance of CUP#2159. Bjoin Limestone applied for a new <br /> CUP in order to revise conditions. A mineral extraction operation existed prior to 2011. <br /> CUP#1262 became effective on April 1, 1996 and expired on April 1,2011. <br /> TOWN ACTION REPORT <br /> On May 24, 2016, The Town of Christiana Plan Commission voted unanimously to approve the <br /> proposal,with only one change to a permit period of 10 years rather than the 15 year period <br /> originally proposed. As of June 7th,the county has not yet received a Town Action Report for this <br /> petition. <br /> DANE COUNTY PLANNING STAFF COMMENTS <br /> Overview: This petition is for a new conditional use permit for mineral extraction in order to amend <br /> conditions of the existing CUP(#2159). The key changes to the conditions, involve the details <br /> related to the hours of operation, a shorter permit period of(10 years vs. 15), and an increased size of <br /> the open excavation area(20 acres vs. 8). In addition, operations, erosion control,and reclamation <br /> plans related to the site are being updated. <br /> Surrounding Area Characteristics:The surrounding area is a mixture of mostly agricultural use <br /> and scattered residential uses. The subject property is located at the intersection of Highland and <br /> Koshkonong Road. <br /> Reclamation Plan: A reclamation plan and reclamation permit(permit#74-98)already exist for this <br /> operation. This permit is based upon a reclamation plan that identifies agriculture as its future land <br /> use. The applicant is in the process of updating the reclamation plan and renewing the permit. <br /> Town Plan: The Town of Christiana Comprehensive Plan identifies the subject property in the <br /> Agricultural Preservation land use district. The plan explains that mineral extraction is allowed as a <br /> conditional use in the district. It also states that the town will discourage non-farm residential <br /> development near existing mineral extraction sites. <br /> Compliance with County Ordinances: Mineral extraction operations must meet requirements <br /> found in Chapters 10, 14 and 74 of the Dane County Code of Ordinances. The application meets the <br /> requirements of section 10.191. The applicant has submitted an erosion control plan/storm water <br /> management plan as required by Chapter 14 of the Dane County Code of Ordinances(DCCO), and a <br /> reclamation plan as required by Chapter 74. Chapter 10 provides six standards for granting a CUP in <br /> Section 10.255(2)(h)of the zoning ordinance are as follows: <br /> 1. That the establishment,maintenance, or operation of the conditional use will not be <br /> detrimental to or endanger the public health, safety, comfort or welfare. <br /> 2. That the uses,values and enjoyment of other property in the neighborhood for purposes <br /> already permitted shall be in no foreseeable manner substantially impaired or <br /> diminished by establishment,maintenance or operation of the conditional use. <br /> 3. That the establishment of the conditional use will not impede the normal and orderly <br /> development and improvement of the surrounding property for uses permitted in the <br /> district. <br /> 4.
