- DECLARATION - 1. WHEREAS, is/are the owner or owners of the following described land in the Town of , Dane County, Wisconsin, to wit: Part of the SE 1/4 NE 1/4 Section 27, Town of Vermont described as follows: Commencing at the North quarter corner of said Section 27; thence 01° 46' 25" West, 1315.62 feet; thence S 88° 58' 32" East, 970 feet to the point of beginning; thence continuing S 88° 58' 32" East, 320 feet; thence S 01° 46' 25" West, 270 feet; thence N 88° 58' 32" West, 320 feet; thence N_01° 46 ' 25" East, 270 feet to the point of beginning. 2. WHEREAS, the said owner of the above-described property now wishes to make certain declarations as to the above-stated property to provide notice within the chain-of-title to the public and any successors in interest to this real property; 3. NOW, THEREFORE, let it be known to the public generally throughout Dane County and elsewhere as well as anyone acquiring title or an interest in the above-stated property that it is intended to provide clear notice by means of this "Declaration" as to the following: A). Present owner/s acknowledge and by means of this notice assure that successors in interest will be informed of the fact that recognition of the existance of an old quarry site located approximately 400 feet East of this property and the potential for future reactivation of the site. This declaration shall run with the land and shall advise all parties now owning any part of said land, their successors, heirs and assigns, and all parties holding under them unless, pursuant to paragraphs 4 or 5 of this instrument, said declaration is amended or terminated. 4. The declaration set forth in paragraph 3. above may be amended in the following manner: A). A written petition calling for the amendment of the declarations may be made by the persons who are, at the time of the petition, owner/s of the lands subject to the declaration. Such petition shall be submitted to the Dane County Clerk who shall refer the petition to the Dane County Zoning & Natural Resources Committee(or successor committee) which committee shall schedule and hold a public hearing on the petition in the same manner as public hearing for zoning amendment petitions are noticed and scheduled. Following such hearing, the committee shall issue a written report on the petition to the County Board of Supervisors which shall, by majority vote, approve or reject the petition. If approved, the petitioner/s shall draft the amendatory covenant instrument, have same executed by the owner/s of the lands subject to the declarations and record same. - 1 -
