ZONING ORDINANCE AMENDMENT NO. 5068 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> VIENNA <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Vienna be amended to include in the R-2 <br /> Residential and RH-1 Rural Homes Districts the following described land: <br /> Pet. #5068: <br /> Part of the SE 1/4 SW 1/4 Section 16, Town of Vienna described as follows: <br /> To R-2: Commencing at the Southeast corner of Lot #1, CSM #5170; thence <br /> continue N 00° 13' 36" West, 315.44 feet; thence N 89° 56' 52" West, 150 feet <br /> to point of beginning; thence N 89° 56' 52" West, 200 feet; thence S 00° 13' <br /> 36" East 200 feet; thence N 89° 57' 55" East, 200 feet; thence N 00° 13' 36" <br /> West, 200 feet to the point of beginning. <br /> To RH-1: Beginning at the Southeast corner of Lot 1, CSM 5170, thence N 00° <br /> 13' 36" West, 315.44 feet; thence N 89° 56' 52" West, 150 feet; thence S 00° <br /> 13' 36" East, 200 feet; thence N 89° 56' 52" West, 200 feet; thence N 00° 13' <br /> 36" West, 200 feet; thence N 89° 56' 52' West, 339 feet; thence S 00° 13' 36" <br /> East, 316.49 feet; thence N 89° 57' 55" East, 689 feet to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. Said property, Lot #1 CSM 5170, shall not be subdivided. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> EFFECTIVE: AUG .i 4 1991 <br />
