The waterway in question is at the end of Barton Rd, west of STH 78, south
of Mt. Horeb in Dane County (see attached maps and photos).
I visited this site with you on April 24, 2008. In Wisconsin, the Supreme Court has defined a
navigable waterway as one which has a defined bed and banks and carries enough water to
float a small watercraft some time during the year. Based on this definition and the conditions
observed at your site, the stream on your property has been determined to be non-navigable.
Therefore, no permits from Wisconsin DNR are needed for work in and near this waterway.
However, certain activities may require permits from Dane Co. and you should contact that
agency before beginning any construction at this site.
If you have any questions, please call me at (608) 275-3330 or Cami Peterson, DNR Water
Management Specialist for Dane County, at (608) 275-3208.
Sincerely,
Donna Sefton
Water Management Specialist
cc: Dane County Zoning Administrator
Dane County Land and Water Resources 1 N3fid0131 13a'8ONINNYldALNf1033NYQ
8002 L Z gay
03A133311
dnr.wi.gov
wisconsin.gov Printed on
Regded
Paper
