ZONING ORDINANCE AMENDMENT NO. 5079 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> BERRY <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning <br /> District Maps of the Town of Berry be amended to include in the RH-2 Rural <br /> Homes District the following described land: <br /> Part of the NE 1/4 NW 1/4 and N 1/2 NE 1/4 Section 36, Town of Berry described <br /> as follows: Beginning at a point in the centerline of Enchanted Valley Road, <br /> said point being East, 1970 feet and South, 670 feet of the Northwest corner of <br /> said Section 36; thence N 62° East, 850 feet; thence S 41° East, 200 feet; <br /> thence S 13° West, 300 feet; thence S 74° East, 220 feet; thence N 85° East, <br /> 1640 feet; thence S 08° Esat, 500 feet to a point in the centerline of <br /> Enchanted Valley Road; thence Southwesterly, 2870 feet, more or less, to the <br /> point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> 1. The above listed description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by <br /> Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. <br /> Failure to record the survey will cause the rezone to be null and void. <br /> 2. The survey shall not create more than 2 parcels. <br /> 3. The access to the lots shall be one double-width shared driveway built <br /> to Town specification. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> 1. Division of the property is not permitted. <br /> 2. Buildings may not be constructed on greater than a 12% slope. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> EFFECTIVE DATE: IQy 13 1991 <br />
