COE226Q6hD2hC2/ MC �e .P.ID,UN <br /> County of Dane <br /> DATE: July 25, 1991 <br /> TO: Town of Vermont <br /> c/o John Bird, Clerk <br /> FROM: Bill Fleck <br /> Zoning Administrator <br /> SUBJECT: Zoning Petition #5084 - Irwin <br /> This petition was re-referred to the zoning committee at the County Board meeting held on <br /> July 18, 91 because of the committee concern that the deed restriction included with the <br /> Town action was too extensive. The restriction as specified would tie up the entire <br /> property and prevent any transfer of land to other than the existing partnership. <br /> I understand from conversation with John Bird that the intent of the Town was just to <br /> prevent the separation of the proposed rezone area from the farm property. May I suggest <br /> that the deed restriction language be directed to that intent only and not to the entire <br /> partnership property. Language such as "the area rezoned shall not be divided from the <br /> primary parcel and made a separate parcel" could suffice. <br /> The zoning committee is meeting on July 30, 1991 and I will include this petition for <br /> their consideration. Please inform me if the suggested language meets with your approval <br /> or, provide us new language to consider. If the committee acts on the petition on the <br /> 30th it will be on the County Board agenda for Aug. 1, 1991. The inclusion of the <br /> restriction will be an amendment to the petition and it will be referred back to the Town <br /> Board for final action after county approval.
