i. a service station dispensing gasoline and diesel fuel and oil; <br /> ii. making minor repairs to automobiles and trucks; <br /> iii. a restaurant; <br /> iv. a truckers' lounge facility which is not a motel,hotel,boarding house, <br /> hostel or lodge; <br /> v. parking of trucks; and <br /> vi. convenience store <br /> (b) The term"service station"shall mean a building from which gasoline and diesel <br /> fuel are sold at retail to automobile and truck drivers, including pumps, tanks for <br /> storage of fuel, paver rent and canopies around the pumps, and auxiliary <br /> equipment to include air pumps for inflating tires, vacuums for cleaning vehicles, <br /> waste containers, windshield washing tools and fluids. <br /> (c) The term "minor repairs" shall mean oil changes, replacement of headlights, <br /> fuses, auxiliary lights, wires, batteries, tires or wheels, coolant, transmission <br /> fluids, filters, lubrication of chassis; adjustments of brakes and similar <br /> maintenance activities, but shall not include rebuilding engines, operations <br /> requiring extensive welding, grinding or hammering, or body work, or painting, <br /> or other operations which usually and customarily require more than two hours <br /> to perform. The intent of this definition is to limit repairs to the kind of service <br /> needed by motorists along the highway to keep their vehicle properly running or <br /> to get it back in operation after minor problems have occurred. <br /> (d) The term"restaurant"shall mean a building for the service of cooked or prepared <br /> food to retail customers, including drive-up windows, to be consumed on or off <br /> premises, but shall not include catering to offsite events. <br /> (e) The term "truckers' lou#ige facility" shall mean a building or area within a <br /> building which is set up tb serve individuals employed in transporting goods and <br /> materials in vehicles which require the driver to hold a commercial driver's <br /> license. A lounge may have chairs, tables, office cubicles, telephones, data ports <br /> or terminals, showers, bathrooms and meeting areas, but may not have beds or <br /> private areas rented to individuals by the hour or the day, nor any areas where <br /> individuals may have sexual contact. <br /> (f) The term"parking of trucks"shall refer to use of land for temporary storage of <br /> trucks used for hauling goods or materials. Trucks may be stopped and left <br /> unattended for as long as $hours,but the use shall not be as a truck terminal,nor <br /> a place where loads are left for more than 8 hours. No truck shall be allowed to <br /> idle for more than 30 minutes except where extreme weather conditions mandate <br /> that trucks be left running] <br /> 4. These restrictions shall constitute covenants running with the land and shall be binding upon <br /> all parties now owning any part of said land, their successors, heirs and assigns, and all parties <br /> holding under them unless, pursuant to paragraphs 5 or 6 of this instrument, said restrictions are <br /> amended or terminated. <br /> -2- <br />
