' 05/02/01 12:37 FAX 414 273 5198 GODFREY & KAHN G lJ004 <br /> i. a service Station dispensing gasoline and diesel fuel and oil; <br /> ii. making minor repairs to automobiles and trucks; <br /> iii. a resta t; <br /> iv. a truckers lounge facility which is not a motel,hotel,boarding house, <br /> hostel or dge; <br /> v. parking o'trucics; and 0 0 0 4 3 7 <br /> vi. convenience store <br /> (b) The term"service station"shall mean a building from which gasoline and diesel <br /> fuel are sold at retail to automobile and truck drivers,including pumps,tanks for <br /> storage of fuel, pavement and canopies around the pumps, and auxiliary <br /> equipment to include 'r pumps for inflating tires,vacuums for cleaning vehicles, <br /> waste containers,wi hield washing tools and fluids. <br /> (c) The term "minor rep irs" shall mean oil changes, replacement of headlights, <br /> fuses, auxiliary ligh , wires, batteries, tires or wheels, coolant, transmission <br /> fluids, filters, lubri ation of chassis; adjustments of brakes and similar <br /> maintenance activiti , but shall not include rebuilding engines, operations <br /> requiring extensive w lding, grinding or hammering, or body work,or painting, <br /> or other operations w .ch usually and customarily require more than two hours <br /> to perform. The into t of this definition is to limit repairs to the kind of service <br /> needed by motorists along the highway to keep their vehicle properly running or <br /> to get it back in operation after minor problems have occurred. <br /> (d) The term`restaurant" all mean a building for the service of cooked or prepared <br /> food to retail custome , including drive-up windows,to be consumed on or off <br /> premises,but shall no include catering to offsite events. <br /> (e) The term "truckers' ounge facility" shall mean a building or area within a <br /> building which is set p to serve individuals employed in transporting goods and <br /> materials in vehicles hich require the driver to hold a commercial driver's <br /> license. A lounge ma have chairs,tables, office cubicles,telephones,data ports <br /> or terminals, showers bathrooms and meeting areas, but may not have beds or <br /> private areas rented t individuals by the hour or the day, nor any areas where <br /> individuals may have xual contact. <br /> (f) The term"parking of cks"shall refer to use of land for temporary storage of <br /> trucks used for hau ' g goods or materials. Trucks may be stopped and left <br /> unattended for as long as 8 hours,but the use shall not be as a truck terminal,nor <br /> a place where loads left for more than 8 hours. No truck shall be allowed to <br /> idle for more than 30 . utes except where extreme weather conditions mandate <br /> that trucks be left ing. <br /> 1 <br /> 4. These restrictions shall constitute ovenants running with the land and shall be binding upon <br /> all parties now owning any part of said and, their successors, heirs and assigns, and all parties <br /> holding under them unless, pursuant to aragraphs $ or 6 of this instrument, said restrictions are <br /> amended or terminated. <br /> -2- <br />
