DANE COUNTY ORDINANCE AMENDMENT NO. 9394 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Burke. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of <br /> Burke be amended to include in the C-2 Commercial District/s the following described land: <br /> PETITION NUMBER/C.U.P. NUMBER: 93 94/1991 <br /> Located in the SE 1/4 of the SE 1/4 of Section 5 and in the NE 1/4 of the NE 1/4 of Section 8, all in Town of <br /> Burke described as follows: Commencing at the North quarter corner of said Section 8; thence S88°22'27" <br /> East 1416.73 feet along the North line of said NE 1/4 of Section 8, to the point of beginning. Thence continue <br /> S88°22'27" East 12.00 feet to the Easterly line of Daentl Road; thence NO1°26'53" East 240.51 feet along said <br /> East line of Daentl Road; thence S68°54'08" East 163.57 feet; thence S88°22'27" East 240.08 feet to the <br /> Westerly line of Interstate Highway 90-94; thence S05°39'52" West 88.13 feet along said Westerly line; thence <br /> S10°30'57" West 115.79 feet along said Westerly line; thence S89°56'00" West 170.80 feet; thence S00°04'00" <br /> East 19.71; feet thence S29°41'57" East 30.45 feet; thence S72°08'35" East 42.23 feet; thence S09°02'19" West <br /> 51.82 feet; thence S40°39'56" West 79.95 feet; thence S10°58'42" West 63.39 feet; thence S27°28'07" West <br /> 52.29 feet; thence S25°42'55" West 56.43 feet; thence S11°25'31" West 53.59 feet; thence S12°32'00" West <br /> 59.00 feet; thence N89°45'01" West 123.04 feet to the Easterly line of Daentl Road; thence N00°14'59" East <br /> 467.33 feet along said Easterly line to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following condition(s). <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if within 90 days of its adoption by Dane County the owner or owners of the <br /> land record the following restriction(s) on said land: <br /> 1) Deed restrict the property limiting the permitted uses exclusively to the following: 10.14(1)(a) all uses <br /> permitted in the C-1 Commercial District without limitations as to size; 10.14(1)(b)major repairs to motor <br /> vehicles; 10.14(1)(c) sales of new and used motor vehicles; 10.14(1)(d) sales of new and used mobile <br /> homes,recreational equipment rental, sales and service; 10.14(1)(e) sales of new and used contractor's <br /> machinery and equipment; 10.14(1)(f)repairs, storage and service of contractor's machinery and equipment; <br /> 10.14(1)(q)parking or storing of motor vehicles; 10.14(1)(s) warehouses. <br /> Said restriction(s) shall run in favor of Dane County and the pertinent Town Board(s) as well as the owners of <br /> land within 300 feet of the site. Failure to record the restriction(s) Will cause the rezone to be null and <br /> void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> EFFECTIVE: � / s / z , <br /> P.c . <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be consistent with the <br /> provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
