Pet. 9683, page 4 of 4: <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane County <br /> Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> 1. Condition that the developer execute an agreement with the Town of Springfield <br /> within one (1) year of the date of rezone approval by Dane County. This agreement <br /> must include a provision explicitly stating "the Developer shall furnish evidence to <br /> The Town of Springfield and to Dane County that the Developer has obtained a <br /> recorded a conservation easement to which Dane County and the Town ofSpringfield <br /> are parties. The easement shall forbid development of a minimum of 78 acres of land <br /> outside the development area. The restriction may not be released without the <br /> consent of all the parties. " A copy of the agreement must be supplied to Dane <br /> County Zoning by the applicant within one (1) year of the date of rezone approval by <br /> Dane County. <br /> Failure to comply with the above conditions in the allotted time period(s)will cause the <br /> rezone to be null and void. <br /> RECORDING OF AN APPROVED PLAT REQUIRED <br /> The above listed description/s is/are intended to describe land for which a plat will be prepared for <br /> approval and recorded. This amendment will become effective, if within one year of its approval by <br /> Dane County,a plat that describes the land to be rezoned is recorded in the office of the Dane <br /> County Register of Deeds. Failure to record the plat will cause this amendment to be null and <br /> void. A copy of the recorded plat shall be submitted to Dane County Zoning. <br /> Effective: 5 I to ° <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon Their findings,to be consistent <br /> with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
