Hoff, Sr. to change the zoning from <br /> the A-1 Exclusive Agriculture district to the RH-1, RH-2 Rural Homes and R-3A <br /> Residential district. <br /> Location: 3746 STH 138 Section 3, SE SE Town Rutland Area: 7.5 more or <br /> less Acres <br /> Proposed use: Create 2 lots by CSM - 1 with duplex capability. D.E.D. Yes. <br /> ANALYSIS; See Town's reasons. <br /> STAFF COMMENTS: <br /> R.P.C. - Petition 5127. This is a substandard parcel ( less than 35 acres as of <br /> June 7, 1978) of 7.5 acres in the Town of Rutland. The adopted <br /> town/county policy for such parcels requires: <br /> The substandard parcel shall be a minimum of 8 acres to be <br /> considered for division. <br /> No more than one new lot will be allowed in any case. <br /> Any lot so created shall be a minimum of one acre. <br /> The proposal Is to divide this 7.5 acre parcel and to allow a duplex on <br /> one of the lots. This raises two policy questions: 1) Should a parcel <br /> of 7.5 acres be divided If the policy says the minimum Is 8 acres? and <br /> 2) Should a duplex be allowed? <br /> You may be able to rationalize splitting this size parcel . There are no <br /> specific policies in the Rutland plan concerning duplexes, but there is <br /> a clear policy to limit lot splits and the amount of non-farm <br /> residential development. There does not appear to be any rationale to <br /> Justify the addition of a duplex. <br /> E.H.D. - <br /> Co. Hwy. - <br />
