ORDINANCE AMENDMENT NO. 5127 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> RUTLAND <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Rutland be amended to include in the R-3A, <br /> RH-2 Rural Homes District the following described land: <br /> Part of the SE 1/4 SE 1/4 Section 3, Town of Rutland described as follows: <br /> TO R-3A: Commencing at the Southeast corner of said Section; thence along <br /> South line thereof, S 89° 36' 37" West, 614.92 feet to the point of beginning; <br /> thence S 89° 36' 37" West, 132.22 feet; thence N 02° 54' 51" East, 478.02 feet; <br /> thence N 87° 05' 09" West, 80 feet; thence N 02° 54' 41" East, 401.52 feet; <br /> - -thence S 79° 51' 47" East, 213.70 feet;- thence S 02° 54' - 51" West, 845.06 feet <br /> to the point of beginning. <br /> TO RH-2: Commencing at the Southeast corner of said Section; thence along <br /> South line thereof, S 89° 36' 37" West, 747.14 feet to the point of beginning; <br /> thence N 02° 54' 51" East, 478.02 feet; thence N 87° 05' 09" West, 80 feet; <br /> 4 thence N 02 54' 51" East, 401.52 feet; thence N 79° 51' 47" West, 190.59 feet; <br /> thence S 02° 31' 06" West, 918.70 feet; thence N 89° 36' 37" East, 263.17 feet <br /> to the point of beginning. <br /> I <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of <br /> the Dane County Code of Ordinances. <br /> CERTIFIED SURVEY REQUIRED <br />'-a <br /> The above listed descriptions are intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by the Dane <br /> County Board of Supervisors a certified survey map that describes the land to <br /> be rezoned is recorded in the Office of the Dane County Register of Deeds. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. Only one residential building is allowed in the area zoned R-3A. The <br /> building may be either a single family dwelling or a duplex (2-family) . <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> EFFECTIVE DATE: DEC ' 0 MI <br />
