ORDINANCE AMENDMENT NO. 5131 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> PRIMROSE <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Primrose be amended to include in the RH-2 <br /> Rural Homes District the following described land: <br /> Pet. #5131: <br /> Part of the N 1/2 NE 1/4 Section 35, Town of Primrose described as follows: <br /> Commencing at the North quarter corner of said Section 35; thence S 89° 30' 54" <br /> East along the North line of Section 35, 483.09 feet to the point of beginning; <br /> thence S 89° 30' 54" E, 1236.36 feet; thence S 01° 35' 01" West, 585.14 feet; <br /> thence S 89° 45' 17" West, 927.88 feet; thence N 25° 59' 47" West, 666.82 feet <br /> to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> 1. The two existing ditches that cross the property in a North-South <br /> direction shall be shown on the survey. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. The residence and any related accessory buildings shall be constructed <br /> between the two ditches which cross the property in a North - South <br /> direction. One ditch is located approximately 300-400 feet from the <br /> East property line and the other is approximately 100 feet in from the <br /> West property line. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> EFFECTIVE DATE: OCT 23 Mn <br />
