Please be advised that I still need a verification
that the area in question actually meets the required criteria described in
the Dane County Shoreland/Wetland ordinance prior to my requesting a map
amendment. If you will recall, we sent you a copy of our notice to Cherokee
Park, Inc. dated Nov. 30, 1990 regarding the requirement for a special
exception permit and in a follow-up phone conversation with you, I discussed
the Concern of the City of Madison Parks Dept. that the project was located in
a wetland. Our wetland maps do not show a wetland in the project area and I
therefore requested that you review the site and make a determination. You
advised me that you would be contacting the Army Corps of Engineers and
requesting their review.
The language in your letter of Mar. 26, 1991 stating "An apparent discrepancy
seems to exist at this site between the shoreland-wetland district boundary
shown on the Wisconsin Wetland Inventory Maps and the actual boundary as
determined by the Corps of Engineers site investigation," does not provide any
information by which I could determine that Dane County could exercise
jurisdiction. Further, the Corps of Engineers report from their investigation
of the site stated only that the road had crossed approximately 186' of
wetlands and since the length was less than 200' the work was authorized by a
nationwide Department of the Army permit. The Corps report also does not
provide me with any practical verification of the status of the wetland with
regard to whether or not Dane County could conceivably have jurisdiction.
