Effective June 8, 2016 <br /> Dane County Board of Supervisors <br /> Amending Chapter 10 of the Dane County Code of Ordinances <br /> Zoning Map Amendment Petition 10943 <br /> Dane County Board of Supervisors does ordain as follows: <br /> The Zoning Districts Maps as referenced under Dane County Code of Ordinance <br /> Section 10.03 shall be amended as follows: <br /> Town Map: Town of Madison Location: Section 35 <br /> Zoning District Boundary Changes <br /> RH-1 TO C-1 <br /> Part of the Southeast Quarter (SE %) of the Southeast Quarter (SE %) of Section Thirty-five (35), <br /> Township Seven (7) North, Range Nine (9) East, in the Town of Madison, Dane County, <br /> Wisconsin, described as follows: Beginning at the Southeast corner of Section 35, Township 7 <br /> North, Range 9 East, thence West along the Section line 282.15 feet to the center of the old <br /> public highway from Madison to Lake View; thence following highway in a Northwesterly <br /> direction, 89.8 feet; thence East, parallel with the Section line, 337.5 feet; thence South, 70.3 <br /> feet to the place of beginning. Said parcel of land may also be described as the South 70.3 feet <br /> of that part of the Southeast% of the Southeast % of Section 35,Town of Madison,that lies East <br /> of the Madison and Oregon Highway. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following <br /> conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if within 90 days of its adoption by Dane County the <br /> owner or owners of the land record the following restriction(s) on said land: <br /> 1. A deed restriction shall be placed on the property to prohibit the erection/placement <br /> of off-premise advertising signs (billboards). <br /> Said restriction(s) shall run in favor of Dane County and the pertinent Town Board(s) as <br /> well as the owners of land within 300 feet of the site. Failure to record the restriction(s) <br /> will cause the rezone to be null and void. A copy of the recorded document shall be <br /> submitted to Dane County Zoning. <br />
