Barker's Subdivision in the SW 1/4 NW 1/4 Section 36, Town of Madison. <br /> COMMUNICATIONS: 09/24/2008 Town of Madison —The Town Board will consider the variance <br /> request at its next scheduled Town Board meeting on October 6, 2008." <br /> VARIANCES REQUESTED: Purpose: Allow new sign faces and electronic message display <br /> improvements to existing non-conforming on-premise pylon sign. <br /> Maximum sign height variance <br /> Maximum sign height permitted: 50 feet, measured from the elevation of the centerline of the <br /> adjacent road to the top of the sign where the speed limit on the adjacent highway is more <br /> than 45 miles per hour (using centerline of West Beltline Frontage Road/East Rusk Avenue). <br /> Proposed sign height: 52.2 feet (no change from height of existing sign). <br /> VARIANCE NEEDED: 2.2 feet <br /> Minimum setback from road right-of-way variance <br /> Minimum setback from right-of way: 5 feet <br /> Actual setback of existing sign: 0 feet from right-of-way of"West Beltline Frontage Road" <br /> to 'overhang' of existing sign <br /> VARIANCE NEEDED: 5 feet. <br /> IN FAVOR: Ryan Coffey, JNB Signs, Inc., Janesville, WI — agent <br /> Mike Coyle, Coyle Carpet, Madison, WI -- owner <br /> OPPOSED: None <br /> ZONING ADMINSTRATOR'S RECOMMENDATION: No recommendation from Zoning Administrator <br /> Roger Lane, as reported by Assistant Zoning Administrator Schutte. <br /> Motion: Studz/Reynolds to grant a variance of 2.2 feet from the maximum permitted 50 feet sign <br /> height, and a variance of 5 feet from the minimum required 5 feet setback from right-of way to allow <br /> new sign faces and electronic message display improvements to existing non-conforming on-premise <br /> pylon sign, as proposed. On a suggestion by Long, Studz and Reynolds accepted a friendly <br /> amendment to add a Condition of Town of Madison approval before a Zoning Permit may be issued. <br /> Finding of Fact: <br /> 1. An existing on-premise pylon sign on C-2 Commercial zoned property serves the Coyle Carpet <br /> One business. Although Zoning Division records include variances and permits for the building on <br /> this lot, there is no history showing permits or variances for this sign. <br /> 2. The owners wish to replace both faces of the existing Coyle Carpet One on-premise pylon sign <br /> and replace the "Electronic Message Center" with a new, energy-efficient LED message sign, with <br /> 40% reduction in power use, because the existing sign can no longer be repaired. The existing <br /> sign head will not be changed. The new electronic message center will be about 6 inches wider, <br /> according to the agent. There will be no other changes to the area, height or location of the <br /> existing sign. <br /> 3. Mr. Coyle stated the sign was built in 1971, and showed a photo of the sign from 1970s records of <br /> the Coyle Carpet business showing the sign. He said the sign was larger originally, and had three <br /> pylons, of which the center support remains; the head of the existing sign cannot be moved "back" <br /> (north) using the existing support. Coyle also presented an old map showing that the East Rusk <br /> Avenue pavement was originally located farther south. <br /> 4. A current survey shows the sign location and height are both non-conforming whether the sign is <br /> considered to serve the West Beltline at 55 MPH or the West Beltline Frontage Road (AKA East <br /> Rusk Avenue) immediately to the west at 25 MPH. According to the Zoning Administrator, the <br />
