Lee: <br /> We noted at the public hearing that the Town Board had acted to deny this <br /> petition. Mr . Clark and Mr . Kreunen reported that you had told them they had <br /> to have 40 acres for each lot . <br /> We have reviewed the Town of Dane Plan, as part of the Dane County Farmland <br /> Preservation Plan, where policy 3, page 5, says: <br /> 1 . Restrict new non-farm development to areas with soils not <br /> classified as prime farmland providing the lot Is at least one and <br /> one-half acre or more In size at a ratio of one lot per 35 acres <br /> owned as of June 28, 1979. The land must be rezoned from <br /> agriculture. <br /> This policy is further discussed in the implementation section of the town <br /> plan on pages 8 and 9. <br /> Thus, it would appear that Mr . Clark with a 300 acre farm could have up to <br /> eight lots if they meet the other criteria: not use any prime farmland, and <br /> not be less than 1-1/2 acres each. <br /> I have attached the RPC staff comments related to Petition 5149, which express <br /> concern over use of prime soils. <br /> If the town has adopted some different policy than that reflected in the <br /> County Farmland Preservation Plan, we need to discuss it as an amendment to <br /> the county plan. <br /> In any event , we would like the reasons for the town's action on this petition <br /> as a matter of coordination of town and county zoning actions related to the <br /> town/county plan. <br /> If you have questions, contact Tom Smiley of the RPC staff at 266-9113. <br /> Sincerely, <br /> Shary Bisgard, Chairman <br /> Dane County Zoning and <br /> Natural Resources Committee <br /> SB: lel <br />
