ORDINANCE AMENDMENT NO. 5153 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> BERRY <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning <br /> District Maps of the Town of Berry be amended to include in the RH-4 Rural <br /> Homes District the following described land: <br /> Part of the SW 1/4 SW 1/4 Section 31, Town of Berry described as follows: The <br /> SW 1/4 SW 1/4 of Section 31, Town of Berry lying South of CTH KP. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of <br /> the Dane County Code of Ordinances. The rezoned area shall be subject to the <br /> following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. Division of the property into smaller parcels is not permitted. <br /> B. The 6 acre, more or less, open field located in the South 600 feet of <br /> East 400 feet of the property shall be preserved as crop land and <br /> minimal encroachment of buildings into this area is subject to Town <br /> Board approval. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> EFFECTIVE DATE: OCT T O P 1991 <br />
