RESTRICTIONS <br /> husband <br /> 1. WHEREAS, Norbert T. Kaltenberg & Tharsella T. Kaltenberg, & wife is/are <br /> the owner/s of the following described land in the Town of Vienna <br /> Dane County, Wisconsin, to-wit: <br /> A parcel of land located in the N 1/2 SW 1/4 of Section 29, Town of Vienna <br /> described as follows: Commencing at the West quarter corner of said Section <br /> 29; thence N 86° 51' 02" East along East-West quarter line of said Section 30, <br /> 229.00 feet to the point of beginning. Thence continue N 86° 51' 02" East <br /> along said East-Westerly line 2411 feet to the Northeast corner of the NE 1/4 <br /> SW 1/4; thence South along the East line of said NE 1/4 SW 1/4 1320 more or <br /> less feet to the Southeast corner of said NE 1/4 SW 1/4; thence West along the <br /> South line ofV the NE 1/4 and NW 1/4 of the SW 1/4 2375 feet to the Southeast <br /> corner of Lot #1 Certified Survey Map #2298; thence N 01° 20' 05" West along <br /> the East line of said Lot #1, 176.00 feet; thence S 88° 20' 15" West along the <br /> North line of said Lot #1, 265.00 feet to a point on the West line of the SW <br /> 1/4; thence North along said West line 380 feet to the extension of the South <br /> line of Lot #1 Certified Survey Map #6644 and the intersection of said West <br /> line; thence N 86° 51' 02" East along said South line of said Lot #1, 191.22 <br /> feet to the most Southeasterly corner of said Lot #1; thence N 05° 34' 53" <br /> West, along the East line of said Lot #1, 212.46 feet; thence N 45° 51' 31" <br /> East, 65.91 feet; thence N 02° 29' 08" West, 687.14 feet to the point of <br /> beginning. <br /> 2. WHEREAS, the said owner desires to place certain restrictions thereon, to <br /> ; bind the owner and those who may acquire title hereafter; <br /> 3. NOW, THEREFORE, in consideration of the mutual benefits passing to and <br /> from the owner and those who may hereafter purchase said land and the <br /> parties named as beneficiaries of these restrictions, the following <br /> restrictions are hereby imposed: <br /> A. Residential buildings are not permitted. <br /> B. Division of the property is not permitted. <br /> These restrictions shall constitute covenants running with the land and <br /> shall be binding upon all parties now owning any part of said land, their <br /> successors, heirs and assigns, and all parties holding under them unless, <br /> pursuant to paragraphs 5 or 6 of this instrument, said restrictions are <br /> amended or terminated. <br /> 4. The restrictions provided for herein shall be enforceable at law or <br /> equity against any party who has or acquires an interest in the land <br /> subject to the restriction by the following parties who are named as <br /> grantees, promisees and beneficiaries with enforcement rights: <br /> (a) The County Government of Dane County, Wisconsin provided that the <br /> lands are under the jurisdiction of zoning ordinance of said County <br /> at the time the enforcement action is commenced; and <br />
