ORDINANCE AMENDMENT NO. 5173 Amending Section 10.03 relating to Zoning Districts in the Town of VIENNA The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Vienna be amended to include in the RH-1 Rural Homes District the following described land: Pet. #5173: Part of the NW 1/4 SW 1/4 Section 29, Town of Vienna described as follows: Following at the Southwest corner of said NW 1/4 SW 1/4 Section 29; thence North 440 feet to the point of beginning; thence East 180 feet; thence North 180 feet; thence Northeast 120 feet; thence North 620 feet to the centerline of Madigan Road; thence West 250 feet; thence South 880 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. CERTIFIED SURVEY REQUIRED The above listed description is intended to describe land for which a certified survey map will be prepared for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane County, a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the survey will cause the rezone to be null and void. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on the land that the above described area will be separated from: A. Residential buildings are not permitted. B. Division of the property is not permitted. Said restrictions shall run in_favor of Dane County and the pertinent Town Board as well as the owners of the land. Failure to record the restrictions will cause the rezone to be null and void. 4 EFFECTIVE DATE: FEB 7 1992
