ORDINANCE AMENDMENT NO. 5173 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> VIENNA <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Vienna be amended to include in the RH-1 <br /> Rural Homes District the following described land: <br /> Pet. #5173: <br /> Part of the NW 1/4 SW 1/4 Section 29, Town of Vienna described as follows: <br /> Following at the Southwest corner of said NW 1/4 SW 1/4 Section 29; thence <br /> North 440 feet to the point of beginning; thence East 180 feet; thence North <br /> 180 feet; thence Northeast 120 feet; thence North 620 feet to the centerline of <br /> Madigan Road; thence West 250 feet; thence South 880 feet to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on the land that the above described area will be separated from: <br /> A. Residential buildings are not permitted. <br /> B. Division of the property is not permitted. <br /> Said restrictions shall run in_favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> 4 <br /> EFFECTIVE DATE: FEB 7 1992 <br />
