1 ORDINANCE AMENDMENT NO. 5174 Page 1 of 2 <br /> 1 Amending Section 10.03 relating to Zoning Districts in the Town of <br /> BLUE MOUNDS <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Blue Mounds be amended to include in the <br /> RH-2 and RH-4 Rural Homes District the following described land: <br /> Part of the SE 1/4 NE 1/4 Section 23 and SW 1/4 NW 1/4 and NW 1/4 SW 1/4 <br /> Section 24, Town of Blue Mounds described as follows: <br /> TO RH-4: Beginning at 1320 feet South of the Northwest corner of the said <br /> Section 24; thence East 1320 feet; thence South 1050 feet, thence S 50° West <br /> 320 feet; thence S 80° West 400 feet; thence N 50° West 330, thence N 10° West <br /> 220 feet; thence S 80° West 100 feet; thence S 30° West 320 feet to the center <br /> of Sand Rock Road; thence Northwesterly along Sand Rock Road 1450 feet more or <br /> less, thence East along the North line of the SE 1/4 NE 1/4, Section 23, 500 <br /> feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of <br /> the Dane County Code of Ordinances. The rezoned area shall be subject to the <br /> following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. A maximum of One acre may be utilized for construction of residences <br /> i and related accessory buildings. Said one acre shall be located in <br /> or in close proximity to the wooded areas on the property. <br /> IA <br /> B. The established drainageways located on the property shall not be <br /> disturbed and shall be properly maintained to prevent erosion and <br /> sediment transportation to the adjacent sensitive river-bottom land. <br /> ...% '" - <br /> The existing field drive shall be used for driveway access for <br /> , � residences. <br /> � Said restrictions shall run in favor of Dane County and the pertinent Town <br /> .sitl•'•-' Board as well as the owners of the land. Failure to record the restrictions <br /> r will cause the rezone to be null and void. <br /> CONDITION <br /> A.
