During a phone conversation with me you requested futher <br /> explanation regarding this matter <br /> The reason for the rezone is because the existing duplex is a nonconforming <br /> use. Section 10.01 (41) of the Zoning Ordinance defines a nonconforming use <br /> as "A lawful use that existed prior to the adoption of an ordinance which <br /> restricted or prohibits said use' . Duplexes prior to 1976 were a permitted <br /> use in all Ag districts but were deleted in 1976 at the request of a majority <br /> of the town boards. Current provisions of the zoning ordinance do not permit <br /> a duplex in the A-1 Exclusive or other Ag Districts. Mr. Ziegler's duplex use <br /> started as a permitted use but became a nonconforming use in 1976. <br /> Mr. Ziegler came to us for a permit to add a garage to his duplex but we could <br /> not issue a permit because Section 10.21 (1)(b) of the zoning ordinance <br /> provides that "No building or premises used as a nonconforming use shall be <br /> added to or structurally altered so as to increase the facilities for such <br /> nonconforming use". Therefore, the only option was to bring the duplex use <br /> into compliance by rezoning the area around the duplex to the R-3A district <br /> which permits duplex use. Many farms in Dane County have followed this <br /> process. <br />
