ORDINANCE AMENDMENT NO. 5177 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> SUN PRAIRIE <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Sun Prairie be amended to include in the <br /> RH-2 and RH-3 Rural Homes District the following described land: <br /> Part of the NW 1/4 NW 1/4 Section 10, Town of Sun Prairie described as follows: <br /> TO RH-2: Commencing at the Northwest corner of said 1/4 1/4, thence East 750 <br /> feet to the point of beginning; thence South, 419 feet; thence East 570 feet; <br /> thence North, 180 feet; thence West, 211.48 feet; thence North 239 feet; thence <br /> West along the North line of 1/4 1/4, 359 feet to the point of beginning. <br /> Also, Commencing at the Northwest corner of said Section 10; thence East along <br /> the North line of said 1/4 1/4, 750 feet; thence South, 419 feet to the point <br /> of beginning; thence continue South, 420 feet; thence East, 570 feet; thence <br /> North, 420 feet; thence West, 570 feet to the point of beginning. <br /> TO RH-3: Beginning at the Northwest corner of said Section 10; thence South <br /> 523.34 feet; thence East 264 feet; thence South 137.33 feet; thence West, 264 <br /> feet; thence South 209 feet; thence East, 750 feet; thence North 839 feet; <br /> thence West along the North line of said 1/4 1/4, 750 feet to the point of <br /> beginning. Also, Commencing at the Northwest corner of said Section 10; thence <br /> South, 523.34 feet; thence East, 264 feet; thence South, 137.33 feet; thence <br /> West, 264 feet; thence South, 209 feet to the point of beginning; thence <br /> continue South, 66 feet; thence East, 264 feet; thence South, 165 feet; thence <br /> East, 134 feet; thence South 220 feet; thence East along the South line of said <br /> 1/4 1/4, 922 feet; thence North, 514 feet along the East line of said 1/4 1/4, <br /> thence West 1320 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed descriptions are intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> CONDITION <br /> A. The certified survey for this property shall include a 66 foot corridor <br /> running East to West across the property from Manley Drive to Town Hall <br /> Drive. <br /> 1. Buildings will not be permitted in the corridor or within 63 feet of <br /> the centerline of the corridor. <br /> 2. Access from Town Hall Drive to Lot 1, CSM 1365 shall be provided via <br /> the corridor.
