ORDINANCE AMENDMENT NO. 5198 Amending Section 10.03 relating to Zoning Districts in the Town of BLUE MOUNDS The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Blue Mounds be amended to include in the RH-3 and RH-4 Rural Homes District the following described land: Part of the S 1/2 NW 1/4 and NW 1/ SW 1/4 Section 36, Town of Blue Mounds described as follows: TO RH-4: Part of the SW 1/4 NW 1/4 of Section 36, described as follows: Commencing at the West quarter corner of said Section 36; thence N 89° 44' 14" East, 1673.61 feet; thence North 66 feet to the point of beginning; thence N 04° 33' 41" East, 184.71 feet; thence N 34° 12' 31" West, 537.53 feet; thence N 26° 33' 18" West, 130.13 feet; thence along a curve to the right with a long chord bearing S 43° West, 240 more or less feet; thence along a curve to the left with a long chord bearing S 30° West, 750 feet; thence along a curve to the right with a long chord bearing South 280 more or less feet; thence N 58° East, 600 feet to the Northeast corner of the NW 1/4 SW 1/4, thence N 89° 44' 14" East, 927.72 feet; thence North 66 feet; thence S 89° 44' 14" West, 574.11 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: A. Residences are not permitted in either of the areas described above. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of the land. Failure to record the restrictions will cause the rezone to be null and void. (continued on page 2) Page 1.
