This section pertains to the general limitations on the size of accessory <br /> structures for particular zoning districts. In previous interpretations it was determined that accessory <br /> buildings within the R- (residential) and RH- (rural home) districts were limited to 50% of the size of the <br /> principal residential structure. Although this is explicitly true for the R- districts, I feel that this <br /> interpretation relating to the RH-districts is against the intent of the ordinance and should be revised. <br /> Section 10.04 starts out with the words, "Except as otherwise herein provided". I feel that that the RH- <br /> district requirements, found in section 10.09, have been drafted with adequate measures to control <br /> accessory structures to meet the intent of the district in regards to size and have been "provided" for <br /> within the requirements of the RH- districts. <br /> The RH- zoning districts are intended to provide zoning areas for residential land uses in conjunction <br /> with livestock, or in essence, farmettes. The larger required parcel allows for a single-family residence <br /> with host of outbuildings for other purposes. Any accessory structures in the RH-district can be <br /> potentially be used for various residential, agricultural, and livestock purposes. In practicality it would be <br /> extremely difficult to decipher the actual use of the accessory structure given the allowances within the <br /> district. <br /> Accessory structures within the RH-1, RH-2, RH-3, and RH-4 Zoning Districts will be allowed at any size <br /> as long as the overall footprints of all the buildings on the parcel do not exceed 10% of the parcel. <br /> Accessory structures shall not be less than 10-feet away from the side and rear property line, as noted in <br /> section 10.09(7),unless they are being used for housing livestock. In that case, accessory structures <br /> housing livestock will be set at least 50-feet from the side and rear property line. <br /> Please see attached matrix summarizing limits of accessory structures. <br />
