TOWN: Approved with no conditions. Motion by Matano/ Hendrick to deny; motion withdrawn by Matano and Hendrick. Motion by Miles/Solberg to postpone the petition until the next work meeting so that alternative home sites can be explored; motion carried, 5-0. 3. PETITION # 10029 by JANELL JULSETH to change the zoning from A-1 EX Exclusive Agriculture to RH-1 Rural Homes to allow REPLACEMENT OF EXISTING RESIDENCE on property located NORTH OF 2461 TOWER ROAD in Section 14, Town of Pleasant Springs. TOWN: Approved with conditions. Motion by Hendrick/Solberg to recommend approval with conditions; motion carried with conditions, 5-0. 1. A Certified Survey Map shall be recorded for the established zoning boundary. 2. The Certified Survey Map shall be recorded within 90 days of the County Executive signature. 3. The balance of the A-1 exclusive land shall be deed restricted prohibiting further residential development. 4. The owner shall obtain a demolition permit for the existing house on the property. 5. If the owner fails to record a Certified Survey Map, a stop work order will be executed on the construction of the replacement home. 4. CONDITIONAL USE PERMIT#2104 by OSCAR HRUBY to allow MINERAL EXTRACTION OPERATION on property located at 6531 MATZ RD in Section 35, Town of Roxbury. TOWN: Approved with conditions. Motion by Hendrick/Matano to approve with 15 conditions; motion carried, 5-0. 1. The applicant shall submit an erosion control plan covering the entire CUP area for the duration of operations, and receive approval of an erosion control permit prior to commencing extraction operations. 2. Reclamation shall meet the requirements of Chapter 74 of the Dane County Code of Ordinances. 3. The applicant shall apply for and receive all other required local, state and federal permits. 4. Operations shall cease no later than 25 (twenty-five) years from the date of CUP approval. 5. The preferred haul route will be Matz Road South to Collins Road to Hwy 12 as per road agreement between Town of Roxbury and Wingra Stone. 6. The access to the driveway shall have gates securely locked when the extraction site is not in operation. The site shall be signed "no trespassing." 7. Normal hours of operation shall be from 6:00 a.m. to 6:00 p.m., Monday through Friday, and from 7:00 a.m. to 1:00 p.m. on Saturdays. No operations of any kind shall take place on Sundays or legal holidays. Exceptions to these hours for public safety projects will occur with prior town notice and approval.
