APPEAL 3560: 1. Appeal 3560 by American Family Insurance Corp Real Estate Q22D (Tim Jordan, Project Manager, J.P. Cullen& Sons, Inc., agent), for a variance from maximum allowable height of a structure permitted within the Dane County Regional Airport Height Limitation Zone as provided by Section 78.03, Dane County Code of Ordinances, to allow temporary construction crane for repairs/alterations to existing building as proposed at 6000 /6052 American Parkway being part of Lot 1, American Center Plat, Section 15, Town 08 North, Range 10 East, City of Madison. GRANTED BY THE DANE COUNTY BOARD OF ADJUSTMENT APRIL, 23, 2009 PUBLIC HEARING, WITH THE FOLLOWING CONDITIONS CONDITIONS FOR PERMIT: 1) FAA approval and 2) Dane County Regional Airport conditions 1) FAA Determinations of No Hazard to Air Navigation Aeronautical Study No. 2009-AGL-1516-0E -- 04/29/2009 Issue Date [Pad #1 location] approved 135' crane at site elevation 951 ft AMSL, Total Height 1086 ft AMSL Intrusion into maximum 1055 elevation shown on AHLZ map at this location is 31 feet (less than the 41 feet approved by the BOA) Conditions of#2009-AGL-1516-OE This aeronautical study revealed that the temporary structure does exceed obstruction standards but would not be a hazard to air navigation provided the following condition(s), if any, is (are) met: 1. As a condition to this Determination, the structure is marked and/or lighted in accordance with FAA Advisory circular 70/7460-1 K Change 2, Obstruction Marking and Lighting, flags/red lights— Chapters 3 (Marked), 4, 5(Red), & 12. 2. As a condition to this determination, the temporary structure must be lowered to the ground when not in use and during the hours between sunset and sunrise. 3. It is required that the manager of Dane Co. Regional-Truax Field at 608-246-3380, be notified at least 1 business day prior to the temporary structure being erected and again when the structure is removed from the site. 4. It is required that the manager of MSN Tower at 608-244-5691, be notified at least 1 business day prior to the temporary structure being erected and again when the structure is removed from the site. Additionally, please provide contact information for the onsite operator in the event that Air Traffic Control requires the temporary structure to be lowered immediately. 5. Any height exceeding 135 feet above ground level (1086 feet above mean sea level) will result in a substantial adverse effect and would warrant a Determination of Hazard to Air Navigation. 6. This determination expires on 12/29/2009 unless extended, revised or terminated by the issuing office. As a condition to this Determination, the structure is marked and/or lighted in accordance with FAA Advisory circular 70/7460-1 K Change 2, Obstruction Marking and Lighting, flags/red lights— Chapters 3 (Marked), 4, 5 (Red), & 12.
