w
fDane County Board of Adjustment Minutes Page 5 of 8
April 23,2009
C. Would avoid removal of trees along Token Creek to make the sign visible from the existing
C-2 zoned area (Schutte noted that clear-cutting within 35 feet of a stream is prohibited by
Shoreland Ordinance regulations);
D. Will comply with Wisconsin Department of Transportation regulations for signs adjacent to
Interstate rights-of-way.
E. Is sized according to specifications dictated by manufacturers of power sports equipment
sold by Mad City Powersports.
7) Knowles discussed his qualifications and the status of his delineation of the Wetlands on the
Vetesnik property. He explained that Interstate Highway construction in the 1950s and 60s
affected the alignment of Token Creek and associated ditches; that the property's former
agricultural use included the pond and associated drainage; and that he is consulting with the
WDNR and U.S. Army Corps of Engineers to confirm the current status of the remaining wetlands
and locations of any remaining boundaries.
8) Vetesnik asked for the Board's support to allow his business to compete fairly, and to provide a
sign location that would not require reducing the height of trees to allow his site and the proposed
sign to be visible. He stated he was attempting to work within the County's processes.
Motion: Schulz/Long to abey action until the applicant can provide a confirmed Wetland boundary
delineation.
Motion carried: 5— 0 by roll call vote: Long —Yes; Reynolds —Yes; Hamre—Yes; Studz—Yes;
Schulz—Yes.
(Staff Note: The Board's action would also allow a new Public Hearing Notice to be published
incorporating the request for setback from the Interstate right-of-way, and would provide feedback
from the ZLR Committee's 05/26/2009 Public Hearing on Petition 10043.)
4. Appeal 3560 by American Family Insurance Corp Real Estate Q22D (Tim Jordan, Project
Manager, J.P.
