As you are aware, the single- family residence, which is located at 82 Oak St, is ithin the floodplain (Zone AE) as noted on FIRM map panel number 55025C0850F effective June 17, 20 3 as is considered a non-conforming structure. A site inspection was conducted on your property n August 5, 2008. It was observed the floodwaters from the last storm event significantly damaged your sin le-family structure. It was observed the floodwaters reached approximately 1 foot above the first floor e evation and substantially damaged the residence in excess of 50% of the assessed value. See attac ed assessment information. Under Dane County Code of Ordinance Section 17 11 (1)(b), non-conforming structures within the floodplain which are destroyed which exceeds 50% of their a sessed value cannot be repaired, reconstructed, or rebuilt, unless the structure is brought in full compliance wi h the Floodplain regulations as found under Dane County Code of Ordinance, Chapter 17, Floodplain Zoning. Since the non-conforming structure was damaged i excess of 50% of the value, you are hereby instructed to bring the entire structure into compliance with the r gulations for structures located within the flood fringe area as noted under DCCO, 17.09(3), see attached. Ple se note that habitable floors shall be at least 2 feet above flood elevation and non-habitable floors must be at r above the flood elevation. If you choose not to rebuild, the structure will be re uired to be razed within 1 year of the date of this letter. Please contact the Zoning Division at(608) 266-4374 on your intentions for the future of this structure so that we can assist you in the necessary requirements and permits needed to be in compliance with Dane County Ordinances and Floodplain regulations.
