Pet. 9590—Cont.: <br /> Page 2 <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> 1. The rezoning shall be effective only if a development agreement incorporating all conditions of <br /> approval is entered into between the Town of Springfield and the developer within 90 days after the <br /> publication of the zoning ordinance amendment. A copy of such agreement shall be filed with the <br /> Zoning Administrator. In the event that such development agreement is not entered into within such <br /> time period,the rezoning shall be null and void. <br /> 2. Within 1 year of the approval date of this petition,landowner will provide the following to the zoning <br /> administrator: <br /> a. A preliminary review letter from the Land Conservation Division of the Dane County <br /> Department of Land & Water Resources showing that it is possible to meet county erosion <br /> control and stormwater management standards on the site; <br /> b. A planting plan to create a buffer that conforms to the standards of s. 10.16(7),Dane County <br /> Code, between all C-2 parcels and: <br /> i. all adjoining parcels zoned to permit residential use, and; <br /> ii. all adjoining legal,nonconfoming parcels under s. 10.16(3), Dane County Code. <br /> c. A subdivision plat,recorded with the Dane County Register of Deeds,that complies with <br /> Chapter 75, Dane County Code and includes the following additional conditions: <br /> i. Access easements to allow property owners who abut STH 19, and also abut the <br /> proposed public road, access to the proposed public road. All easements, driveways <br /> and access points must comply with Chapter 75, Dane County Code, the Town of <br /> Springfield Land Division Ordinance and any applicable requirements of the <br /> Wisconsin Department of Transportation. <br /> ii. A public street right-of-way, dedicated to the Town of Springfield, to the east <br /> property line of the development, and a cul-de-sac bulb abutting the property line at <br /> such location, as shown on the concept plan for the project. Street and intersection <br /> improvement design, location and construction will be at developer's expense and <br /> must comply with all standards of Chapter 75,Dane County Code and any applicable <br /> standards of the Town of Springfield and the Wisconsin Department of <br /> Transportation. <br /> 3. The stormwater management system will direct the stormwater from the property being rezoned <br /> away from the existing residential parcel which abuts the intersection of STH 19 and US 12. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be consistent with the <br /> provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
