<br /> This agreement, executed in duplicate, by and between Rorge t
<br /> Bros., Inc., a Wisconsin Corporation, party of the first part and
<br /> Russell J. Rorge, party of the. second part, and First National Dank
<br /> of Stoughton, party of the third part,
<br /> WITNESSETH:

<br /> Rorge Bros., Inc., a Wisconsin Corporation, is the owner cf
<br /> C all of the land comprising the Second Addition to Riverwood Estates in * -
<br /> A' the Town of Dunkirk, Dane County, Wisconsin except Lots One (1) and c ---'
<br /> n Two (2), Block Nine (9) , Second Addition to Riverwood Estates, title
<br /> g to which is in Russell J. Rorge, the second party herein.
<br /> •v Lots One (1) and Two (2) , Block Nine !9) , are now subject
<br /> .. to certain restrictions on use set forth in Warranty Deed from Russell .
<br /> J. Rorge and Gilmore A. Rorge to Jerome C. Nelson, dated July 16, 1979,
<br /> recorded July 18, 1979 in Vol. 1079 of Records, page 626, Doc. ?1630861, i
<br /> Dane County Registry.
<br /> It is the intent of the parties hereto, as the present owners
<br /> ,s, of all of the real estate comprising the Second Addition to Riverwood
<br /> b Estates, in the Town of Dunkirk, Dane County, Wisconsin, that all of
<br /> o . the said real estate, except Lots One (1) , Two (2) and Three (3), Block
<br /> Nine (9) , Second Addition to Riverwood Estates, now owned by Rorge ,
<br /> Bros., Inc., the first party herein, shall when sold and conveyed, be
<br /> . Made subject to the modified restrictions on use, attached hereto and
<br /> made a part hereof.
<br /> NOW, THEREFORE, IT IS :MUTUALLY AGREED, BY AND BETWEEN THE
<br /> PARTIES AS FOLLOWS:
<br /> 1. That all of the real estate comprising the Second Additian
<br /> to Riverwood Estates, in the Town of Dunkirk, except Lots One (1) , Roo.
<br /> • (2) and Three (3) , Block Nine (9) of said addition, shall, when sold aad
<br /> conveyed by Rorge Bros., Inc. , the first party herein, the owner thereof,
<br /> ae made subject to the modified restrictions on use, a copy of which is
<br /> . attached hereto and made a part hereof.
<br /> 2. That Lot Three (3) , Block Nine (9) , Second Addition to
<br /> Riverwood Estates, now owned by Rorge Bros., Inc. , shall, when sold and •
<br /> conveyed, be made subject t.o .the restrictions on use in the form and
<br /> content as set forth as restrictions On use in the Warranty Deed from
<br /> Russell J. Rorge and Gilmore A. Rorge to Jerome C. Nelson, referred to
<br /> above.
<br /> 3. That Lots One (1) and Two (2) , Block Nine (9) , Second
<br /> Addition to Riverwood Estates, shall remain subject to the restrictions
<br /> t on use as sct forth in Warranty Deed from Russell J. Rorge and Gilmore
<br /> ,:",; A. Rorge to Jerome C. Nelson, referred to above.
