<br /> It is the intent of the parties hereto, as the present owners
<br /> of all of the real estate comprising the Second Addition to Riverwood
<br /> Estates, in the Town of Dunkirk,' Dane County, Wisconsin, that all of
<br /> the said real estate, except Lots One (1) , Two (2) and Three (3) ,
<br /> Block Nine (9) , Second Addition to Riverwood Estates shall be made
<br /> subject to the modified restrictions on use, attached hereto and
<br /> made a part hereof.
<br /> NOW, TI(EREFORE, IT IS MUTUALLY AGREED, BY AND BETWEEN THE
<br /> PARTIES AS FOLLOWS:
<br /> 1. That all of the real estate comprising the Second Addition
<br /> to Riverwood Estates, in the Town of Dunkirk, except Lots One (1)
<br /> Two (2) and Three (3) , Block Nine (9) and Lot Fifteen (15), Block Ten
<br /> (10) of said addition. shall be made subject to the modified restrictions
<br /> on use, a copy of which is attached hereto and made a part hereof.
<br /> • 2. That Lot Three (3) , Block Nine (9) , Second Addition to
<br /> Riverwood Estates, now owned by Rorge Bros., Inc. , shall, when sold and
<br /> conveyed, be i..ade subject to the restrictions on use in the form and
<br /> content as set forth as restrictions on use in the Warranty need from
<br /> Russell J. Rorgu and Gilmore A. Rorge to Jerome C. Nelson, referred to
<br /> above.
<br /> 3. That Lots One (1) and Two (2) , Block Nine (9) , Second
<br /> Addition to Riverwood Estates, shall remain subject to the restrictions
<br /> on use as set forth in Warranty Deed from Russell J. Rorge and Gilmore
<br /> A. Rorge to Jerome C. Nelson, referred to above.
<br /> 4. That Lot Fifteen (15) , Block Ten (10) , Second Addition to
<br /> Riverwood Estates shall remain subject to the modified restrictions on
<br /> use as set forth in agreement of October 24, 1980, referred to above.
<br /> The First National Bank of Stoughton, owner and holder of
<br /> mortgages on all of the real estate comprising the Second Addition
<br /> •
<br /> to Riverwood Estates, except Lots One (1) and.Two (2) , Block Nine (9)
<br /> and Lot Fifteen (15) Block Ten (10) of said Plat, joins in the execution
<br /> of this agreement solely for the purpose of consenting to the modifications
<br /> of the restrictions on use, as herein set forth.
