The Landowner retains the right to renew from time to time, the tax law Forest Plan with the
<br /> State of Wisconsin.
<br /> 2.9 Vehicles. There shall be no operation or storage of vehicles of any kind outside of driveways and
<br /> parking areas on the Property, including, but not limited to, motorcycles, cars, trucks, skidders,
<br /> farm vehicles, and motorized and non-motorized recreational vehicles, except that farm and
<br /> utility vehicles may be used to conduct management activities in accordance with the Land
<br /> Management Plan described in Paragraph 2.11, for handicapped access, and to recover deer
<br /> carcasses. Skidders and logging vehicles may be operated for forest management and harvest
<br /> activities, in accordance with the Forest Plan described in Paragraph 2.7. It is understood that
<br /> field roads, lanes, trails or other normally traveled routes will be utilized for vehicle access
<br /> whenever possible. Vehicle use and parking associated with special events or in conjunction
<br /> with the Bed and Breakfast identified in Paragaph 2.4 may also occur with prior written approval
<br /> by the County.
<br /> 2.10 Water. There shall be no manipulation or alteration of any water body on or adjacent to the
<br /> Property or its shoreline.
<br /> For the purpose of this Easement, a water body means a creek, stream, intermittent stream,
<br /> drainage way, river,pond, lake, surface or subsurface spring, wetland or other body of water.
<br /> 2.11 Agriculture. Agricultural Operations may be conducted on the entire Property but only if such
<br /> activities are in accordance with a Farm Plan approved in writing by the County. The Farm Plan
<br /> shall be prepared by the United States Department of Agriculture, Natural Resources
<br /> Conservation Service ("NRCS")or the Dane County Land Conservation Division, or their
<br /> successor agencies or designees. The Farm Plan must meet the standards and specifications of
<br /> the NRCS and adequately address soil and water conservation, pest management, nutrient
<br /> management, and habitat protection. The Farm Plan shall be updated by the NRCS or the Dane
<br /> County Land Conservation Division from time to time, or whenever Agricultural Operations on
<br /> the Property change in a manner that may adversely affect the Purpose of this Easement,or upon
<br /> any change in ownership of the Property.
<br /> a. For the purposes of this Easement, "Agricultural Operations" means beekeeping, dairying,
<br /> egg production, floriculture, grazing, livestock raising, orchards, nurseries, raising of grain,
<br /> grass, seed crops, vegetables, fruits, nuts and berries, placing land in federal programs in
<br /> return for payments in kind; owning land, at least 35 acres of which is enrolled in the
<br /> Conservation Reserve Program under 16 USC 3831 to 3836; and participating in the milk
<br /> production termination program under 7 USC 1446.
<br /> b. For the purposes of this Easement, livestock means farm animals that are kept for human
<br /> use or raised for sale or profit, including,but not limited to, bovine animals, sheep, goats,
<br /> swine, poultry, llamas, ostriches,emus and equine animals. Livestock does not include
<br /> small domestic pets, such as dogs and cats that are customarily permitted by local
<br /> ordinance.
<br /> 3. Additional Reserved Rights of the Landowner. In addition to rights reserved by the Landowner
<br /> pursuant to Paragraph 2 above,the Landowner retains all rights associated with ownership of the
<br /> Property, including the right to use the Property, and invite others to use the Property, in a manner that
<br /> is not expressly restricted or prohibited by the Easement or inconsistent with the Purpose of the
<br /> Easement. The Landowner may not, however,exercise these rights in a manner that would adversely
