Any changes due to colocation or <br /> otherwise shall be reviewed by the Zoning Administrator prior to <br /> implementation to determine if permits are needed and to <br /> determine that such changes are in compliance with terms of the <br /> CUP and does not signifacantly alter the appearance or structural <br /> integrity of the Tower approved and permitted under this CUP. <br /> 10 . If at any time the communication tower permitted under <br /> Conditional Use Permit No. 1665 ceases to be used for the primary <br /> use, as identified in paragraph 1 above, for a continuous period <br /> of 12 months the permit holder shall, upon notification by the <br /> committee, dismantle and remove the tower. If the tower is not <br /> removed within 30 days of such <br /> notification, Dane County may enter upon the premises and remove <br /> the tower at the expense of the holder of the conditional use <br /> permit. <br /> 11 . The existing 150 foot lattice tower shall be removed <br /> within 90 days of completion of the new tower. <br /> 12 . CUP 1665 shall not become effective until Conditional Use <br /> Permit 1654 is withdrawn or denied. <br /> 13. Failure to comply with any of the aforesaid conditions shall <br /> be grounds for the committee to immediately revoke Conditional Use <br /> Permit No. 1665 . <br /> THE ZONING AND NATURAL RESOURCES COMMITTEE AFTER PUBLIC HEARING <br /> AND IN THEIR CONSIDERATION OF THE CONDITIONAL USE PERMIT MADE THE <br /> FOLLOWING FINDING OF FACT: <br /> 1 . That the establishment, maintenance and operation of the <br /> proposed conditional use will not be detrimental to or endanger <br /> the public health, safety, morals, comfort or general welfare. <br /> 2 . That the uses, values and enjoyment of other property in the <br /> neighborhood for purposes already permitted will not be <br /> substantially impaired or diminished by the establishment, <br /> maintenance and operation of the proposed conditional use . <br /> 3 . That the establishment of the proposed conditional use will not <br /> impede the normal and orderly development and improvement of <br /> the surrounding property for uses permitted in the district . <br /> 4 . That adequate utilities, access roads, drainage and other <br /> necessary site improvements will be made. <br />
