or any other equipment or structure placed or erected pursuant to the conditional use permit,
including payment for such removal by Dane County or its agent, in the event the permit is revoked
or the use permitted there under ceases for a continuous period of 12 months. Said bond shall
expressly state that it will remain in full force and effect for a period of at least six months after the
surety provides Dane County written notification of expiration or termination of the surety's obligation
under the bond. Applicant shall remove any communication tower, array or any other equipment or
structure placed or erected pursuant to the conditional use permit no less than 30 days prior to the
termination or expiration of the bond required hereunder.
12. The applicant shall provide proof of compliance with, or non-applicability of, all relevant Federal
Aviation Administration (FAA) regulations, including an FAA 7460-1 Air Space review.
13. Contact with Wisconsin DOT Bureau of Aeronautics should be made prior to construction, if it has
not already been done, to determine whether notification to that agency is required.
14. Verizon should verify if the Docken private airport is still in operation, and if so, notify the operator of
that facility of the tower proposal.
15. All tower components, appurtenances and transmission lines should be securely bonded and
grounded to prevent RF interference caused by stray signals.
16. A Wisconsin-licensed Professional Engineer should approve the finished tower, and certify that the
tower can support up to two(2)additional cellular/PCS antenna arrays.
17. Verizon Wireless Personal Communications should utilize a galvanized or painted finish on the
tower to minimize visual impact, if permitted by the FAA.
18. The provider shall paint steel appurtenances the same color as the tower to minimize visual impact.
19. A security/screening fence shall be placed around the tower compound as indicated in the site
plans dated 10/28/08.
20. The holder of Conditional Use Permit No. 2098 shall be responsible for obtaining Town Board
approval prior to any lighting being installed on the tower.
21. Failure to comply with any of the aforesaid conditions shall be grounds for the committee to
immediately revoke Conditional Use Permit No. 2098.
THE ZONING AND LAND REGULATION COMMITTEE AFTER PUBLIC HEARING AND IN
THEIR CONSIDERATION OF THE CONDITIONAL USE PERMIT MADE THE
FOLLOWING FINDINGS OF FACT:
1. That the establishment, maintenance and operation of the proposed conditional use will not be
detrimental to or endanger the public health, safety, morals comfort or general welfare.
2. That the uses, values, and enjoyment of other property in the neighborhood for purposes already
permitted will not be substantially impaired or diminished by the establishment, maintenance, and
operation of the proposed conditional use.
3. That the establishment of the proposed conditional use will not impede the normal and orderly
development and improvement of the surrounding property for uses permitted in the district.
4. That adequate utilities, access roads, drainage and other necessary site improvements will be
made.
G:\My Documents\CUP #2098.doc
