LIZ ( 4(e,
WINCH AND WINCH LAW OFFICES
ATTORNEYS AT LAW
4 WEST HUDSON STREET
THOMAS H.WINCH 36 EAST HUDSON STREET JAMES T.WINCH
(608)795-2284 MAZOMANIE,WISCONSIN 53560 (608)795-4216
August 24, 1990
Sharon Biscard RECEIVFn
Dane County Zoning Committee
Room #116, City-County Building ' 91
Madison, WI 53709 Ua 27
DANE CGUNT:'
Re: Jerome Brunner Zoning Petition #4849 LAND REG. & RECO.:DS
I thought that it would be appropriate to let the Committee understand that
we were not in complete agreement with statements that were made by the Regional
Planning Commission Staff regarding the above zoning petition which was filed
with your Committee. Accordingly, we wish to supply the Committee with pictures
of the exact site that we are requesting be rezoned, so that you can understand
the nature of the property and why we are requesting the zoning changes that
we are requesting. We are currently trying to work with the Town regarding what
is the best possible rezoning that can be made of the property that is still
consistent with their zoning policies and compatible with the surrounding area.
This is the reason why at this time we have requested that consideration of this
rezoning request be postponed, so that we can address such concerns. However,
we also feel that it is appropriate to let you know what property is involved
and where our dispute is with the Regional Planning Commission.
I have enclosed as the Picture #1 , the house which we are requesting be
rezoned as R-1 residential property. This is the property that is currently
owned by Jerry Brunner's mother and father, Leo and Hilda Brunner. The property
is easily accessible to Highway KP and the farm outbuildings all lie either
directly behind the house, or in that general vicinity. We believe that such
parcel can be zoned as R-1 without any problems of any nature. That house has
been there for 20 years and Jerry's parents would like to live in that house
for as long as they live and this is why we seek to have the zoning changed to
R-1. As you can see from the picture with the current road in there, this
property is easily accessible for emergency vehicles and there is very safe access
on to existing County Trunk Highway KP, as the road is straight for a long
distance both East and West at this point. In addition, the property is located
in such proximity with the existing farm buildings that we believe that any person
who would decide to purchase such property would have notice that an existing
farm use exists there and they would not wish to purchase such property if they
would find that the use of such land for agricultural purposes to be offensive
to them. Accordingly we feel that such R-1 parcel can clearly be justified and
we have received no opposition to such zoning.
I have also enclosed pictures of the land that we seek to have zoned as
A-2 lands. I have numbered those pictures as #2 through #8. Picture #2 shows
the land that lies directly East of the property that we proposed to have zoned
R-1, and this is the area where the Garfoot Creek travels. The creek itself
parallels the cornfield and crosses KP where the bridge is shown on the picture.
The rest of the pictures #3 through #7 show all of the buildings that accompany
the parcel that we are requesting be zoned A-2.
