I found that Dane County Zoning does not have any record that Pet. 4851 is effective. The <br /> application to expand the B-1 Local Business zoned area was approved by the Zoning Committee and County Board in <br /> 1990 subject to a requirement that the owner record the following Deed Restriction within 90 days of the County Board's <br /> approval on 10/02/1990: <br /> "A. No new buildings are to be constructed in the B-1 zoned area." <br /> I searched the Register of Deeds records for a Deed Restriction document recorded around that time in that <br /> location, but did not find anything. Unless the current owners can prove that the document was recorded as required, <br /> unfortunately Petition 4851 must be considered void, leaving only the small original B-1 zoned area. <br /> If the building in question can be expanded and still meet the setbacks and lot coverage restrictions for the original <br /> B-1 area, a Zoning Permit may be issued. If not, Ms. Erb may wish to apply again to expand the B-1 zoning.
