In <br /> order to get approval of the CSM we were asked to dedicate land for a cul <br /> da sac. This was your assurance we would not develope. We were never <br /> told that if someone else should develope we would have to put in the <br /> cul-da-sac. We were not asked to produce a bond nor did we enter into any <br /> contract with the Town of Westport as it states in your ordinance dated <br /> March 16, 1982, section 3 and 5. <br /> This shows that Westport as you have even stated, never intended for us to <br /> put this in. Again it was your assurance of no development. <br /> We have done some research and found that two other land divisions were <br /> approved. One in 1985 the other in 1988 around the same time as our <br /> request was in front of you. <br /> The CSM recorded March 28, 1985 was for Anthony Di Fiore 3924 South <br /> Meadow Dr, Middleton. His land, which he subdivided, meets one end of <br /> South Meadow Circle. The other CSM recorded October 26, 1988, property <br /> owner being Ed Gehl 3915 South Meadow Dr. Middleton. This property, <br /> which was subdivided, meets the other half of the cul-da-sac at the end of <br /> South Meadow Dr. <br /> Neither one of these property owners were asked to even upgrade the <br /> cul-da-sac which now exists at approx. 52 feet in diameter. Your <br /> ordinance which was in effect before any of these land divisions came in <br /> front of you, states a required 75 foot diameter. According to the CSM <br /> the land is already dedicated for this required size of the cul-da-sac. <br /> There was no need for them to even dedicate land. <br /> The cul-da-sac that exists at the end of Sumac Circle is also approx. <br /> 52 feet in diameter and 66 feet was dedicated when the original South <br /> Meadow plat was developed. <br /> William Marshall , who after us, came in front of you with the Emslie <br /> Plat, which is the development of 10 lots along Sumac Circle. He was not <br /> requird to dedicate land for a cul-da-sac or install the cul-da-sac. <br /> Instead you opted to have us install the cul-da-sac since we had already <br /> dedicated the land for that purpose. We feel as though we were treated <br /> unfairly throughout the approval process. There were requirements made of <br /> us that were not made for others. The ordinance seems to be enforced upon <br /> us but not others. <br /> 4 <br /> • <br /> ( <br />
